Terms of Service

1. Agreement to Terms
By accessing or using ShearBook (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old to create an account. By creating a stylist account, you represent that you hold valid licenses required by your state to perform the services you list.
3. Accounts
You are responsible for maintaining the security of your account and all activity under it. You must provide accurate information when creating your account. ShearBook reserves the right to suspend or terminate accounts that violate these terms.
4. Stylist Obligations
Stylists agree to:
- Provide accurate service descriptions, pricing, and availability
- Honor bookings made through the Platform
- Maintain current and valid professional licenses where required
- Comply with all applicable local, state, and federal laws
- Not engage in discriminatory practices
5. Client Obligations
Clients agree to:
- Show up on time for scheduled appointments
- Provide accurate contact information
- Pay for services as agreed at the time of booking
- Comply with the cancellation and no-show policies set by each stylist
6. Payments, Fees & No Refunds
ShearBook processes client-to-Pro payments through Stripe. Pros receive payouts directly to their connected bank account. The Platform charges a flat 5% booking fee on each transaction. Stripe's processing fees (~2.9% + $0.30) are separate and apply to all transactions.
Subscription fees are billed monthly and are non-refundable for the current billing period. You may cancel your subscription at any time.
All bookings are final. Deposits are non-refundable. Payments for completed services are non-refundable. Pros are independent professionals — not employees, agents, or representatives of ShearBook. Refunds for services are not ShearBook's responsibility and are strictly between you and your Pro. ShearBook does not issue, process, or guarantee refunds for services rendered by Pros. 6a. Pro Subscriptions (Web & Android)
If you are a Pro purchasing a ShearBook subscription on the web (shearbook.app or shearbook.beauty) or on Android, subscriptions are billed by ShearBook through Stripe.
- Plans: Starter $39/month, Pro $59/month, Elite $99/month. Each plan includes a 14-day free trial for new Pros.
- Auto-renewal: Subscriptions automatically renew on a monthly basis until canceled.
- Cancellation: Cancel any time from Pro → Billing → Manage Billing. Cancellation takes effect at the end of the current billing period. Subscription fees already paid are non-refundable.
- Free trial: If you cancel during the 14-day trial you will not be charged. If you do not cancel, the first monthly charge occurs automatically at the end of the trial.
7. Cancellations & No-Shows
Cancellation and no-show policies are set by individual stylists. Clients agree to the stylist's posted policy at the time of booking. ShearBook enforces these policies automatically, including any applicable fees. Deposits are non-refundable regardless of the reason for cancellation.
7a. Chargebacks & Payment Disputes
Filing a chargeback or payment dispute with your bank or credit card company for a legitimately booked or completed service is a violation of these Terms and will result in immediate and permanent termination of your ShearBook account.
Beauty services cannot be “returned.” Once a Pro has performed a service or held a time slot for you, they have earned their compensation. If you have a concern about a service, you must contact the Pro directly or reach out to ShearBook support before initiating any dispute with your payment provider.
ShearBook and/or the affected Pro reserve the right to pursue recovery of all losses, fees, and damages resulting from fraudulent or illegitimate chargebacks. ShearBook will provide full transaction records and booking evidence to payment processors in response to all disputes.
8. Promotions & Advertising
Promoted listings, boosts, featured spotlights, and social spotlights are subject to ShearBook's scheduling rules. All promos go live on Wednesday. Submissions must be received by Monday at 8:00 PM for the following Wednesday. ShearBook reserves the right to reject promotional content that violates these terms or community standards.
9. Intellectual Property
All content you upload (photos, descriptions, branding) remains yours. By uploading content, you grant ShearBook a license to display it on the Platform and in promotional materials (including social spotlights). ShearBook's branding, design, and technology are owned by ShearBook, Limited Co.
10. Content Standards & Moderation
All images and content uploaded to ShearBook — including profile photos, cover images, portfolio images, reference photos, and service images — must meet the following standards:
- Content must be relevant to beauty, grooming, or personal care services
- No nudity, sexually explicit, or sexually suggestive content
- No violent, graphic, gory, or disturbing imagery
- No vulgar, obscene, or offensive language in images or text
- No hate speech, symbols, or imagery promoting discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any protected class
- No copyrighted material you do not own or have permission to use
- No images of minors without parental consent
- No spam, advertisements for other platforms, or irrelevant content
ShearBook reserves the right to review, flag, remove, or reject any uploaded content at its sole discretion. Content that violates these standards may be removed without notice. Repeated violations may result in account suspension or permanent termination.
Uploaded images may be subject to automated or manual review before being published. ShearBook may use automated tools to detect prohibited content. Users may report content that violates these standards, and ShearBook will review all reports promptly.
11. Prohibited Conduct
You may not:
- Use the Platform for any unlawful purpose
- Harass, abuse, or discriminate against other users
- Post false, misleading, or fraudulent information
- Upload offensive, vulgar, sexually explicit, or violent content
- Attempt to circumvent Platform fees by arranging payments outside ShearBook
- Scrape, copy, or reverse engineer the Platform
- Use the Platform to distribute harmful, abusive, or inappropriate material
12. Limitation of Liability
ShearBook provides the Platform “as is.” We are not liable for disputes between stylists and clients, service quality, or any damages arising from use of the Platform. ShearBook is a marketplace — we connect clients and professionals but do not employ or supervise stylists.
13. Termination
ShearBook may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time through your settings. Upon termination, any outstanding balances will be settled according to Stripe's payout schedule.
14. Changes to Terms
ShearBook may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify users of material changes via email.
15. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SHEARBOOK DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
16. Independent Contractors
Stylists and beauty professionals on ShearBook are independent contractors, not employees, agents, or representatives of ShearBook. ShearBook does not control how, when, or where stylists perform their services. ShearBook is not responsible for the quality, safety, legality, or suitability of any services provided by stylists.
17. Assumption of Risk
Clients acknowledge that beauty services carry inherent risks including but not limited to allergic reactions, skin irritation, or dissatisfaction with results. Clients assume all risk when booking and receiving services through the Platform. ShearBook strongly recommends communicating allergies, sensitivities, and expectations directly with your stylist before your appointment.
18. Indemnification
You agree to indemnify, defend, and hold harmless ShearBook, Limited Co., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any services you provide or receive through the Platform.
19. Limitation of Damages
IN NO EVENT SHALL SHEARBOOK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION. SHEARBOOK'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SHEARBOOK IN THE 12 MONTHS PRECEDING THE CLAIM.
20. Dispute Resolution
Pros are independent professionals, not employees or agents of ShearBook. Any disputes between clients and Pros — including refunds, service quality complaints, and payment disagreements — are strictly between you and the Pro. ShearBook is not responsible for resolving these disputes and has no obligation to issue refunds on behalf of any Pro.
Pros set their own refund and cancellation policies. ShearBook does not mediate, adjudicate, or make refund decisions for services rendered by Pros. If you have a concern about a service, you must resolve it directly with your Pro.
Any disputes between you and ShearBook (not involving a Pro's services) shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
21. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. Any legal action must be brought in the courts located in the State of Georgia.
22. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
23. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShearBook regarding your use of the Platform.
